Bulk Return & Exchange Policy

Inspection: Buyer shall inspect the Products within five (5) days of receipt (“Inspection Period”) of the Products and either accept or, if such Products are Nonconforming Products, reject such Products. The quantity of any installment of Products as recorded by Ad Astra upon delivery to the carrier identified in the Purchase Order is conclusive evidence of the quantity received by Buyer on delivery unless Buyer can provide conclusive evidence proving the contrary. Buyer will be deemed to have accepted the Products unless it notifies Ad Astra in writing of any Nonconforming Products within the Inspection Period and furnishes such written evidence or other documentation as required by Ad Astra. If Buyer timely notifies Ad Astra of any Nonconforming Products, Ad Astra shall determine, in its sole discretion, whether the Products are Nonconforming Products. If Ad Astra determines that the Products are Nonconforming Products, it shall, in its sole discretion, (i) replace such Nonconforming Products with conforming Products, or (ii) refund the Price for such Nonconforming Products.  Buyer shall ship, at its expense and risk of loss, the Nonconforming Products to the facility specified in the Purchase Order. If Ad Astra exercises its option to replace Nonconforming Products, Ad Astra shall, after receiving Buyer’s shipment of Nonconforming Products, ship to Buyer, at Ad Astra’s expense and Buyer’s risk of loss the replaced Products to the Delivery Location.  

 

BUYER ACKNOWLEDGES AND AGREES THAT THE REMEDIES SET FORTH IN THIS SECTION ARE BUYER’S EXCLUSIVE REMEDIES FOR THE DELIVERY OF NONCONFORMING PRODUCTS.

 

Limited Right of Return. Except as expressly provided in the Agreement, Buyer has no right to return Products purchased under the Agreement to Ad Astra.

 

Risk of Loss. Risk of loss to all Products ordered under any Purchase Order passes to Buyer upon Ad Astra’s tender of such units to the third-party carrier.

Shipping Policy

Any time quoted by Ad Astra for delivery is an estimate only. Ad Astra is not liable for any loss or damage arising from any delay in filling any order, failure to deliver or delay in delivery. No delay in the shipment or delivery of any Products relieves Buyer of its obligations under the Agreement, including without limitation accepting delivery of any remaining installment(s) of Products.  

 

Packaging and Labeling. Ad Astra shall properly pack, mark, and ship Products and provide Buyer with shipment documentation showing the Purchase Order number, Ad Astra’s identification number for the subject Products, the quantity of pieces in shipment, the number of cartons or containers in shipment, Ad Astra’s name, the bill of lading number, and the country of origin.

BULK DELIVERY TERMS;  FOB

Free on Board" means that the seller fulfills his obligation to deliver when the goods have passed over the ship's rail at the named port of shipment. This means that the buyer has to bear all costs and risks of loss of or damage to the goods from that point. Further, if the product requires additional customs duties, export paperwork, or inspections or rerouting, the buyer must cover these expenses. Once the freight loads, the buyer becomes responsible for all other costs. • A minimum of 7 days lead time required.

FOB Origin. "FOB origin" (also sometimes phrased as "FOB shipping" or "FOB shipping point") indicates that the sale is considered complete at the seller's shipping dock, and thus the buyer of the goods is responsible for freight costs and liability during transport.

FOB Destination. Free on Board Destination is an expense seller pays and bears the freight charges and owns the goods while they are in transit. The term means that the buyer takes delivery of goods being shipped to it by a supplier once the goods arrive at the buyer's receiving dock. The seller pays and bears the freight charges and owns the goods while they are in transit. Further, if the product requires additional customs duties, export paperwork, or inspections or rerouting, the seller must cover these expenses.
